If an individual (aggrieved) believes they have been discriminated against, they should:
- Contact an EEO Counselor within 45 calendar days of the alleged discriminatory act;
- Make an election:
- for counseling with the EEO Counselor, or
- to participate in Mediation.
- If during counseling or mediation, the claim(s) have not been resolved, the aggrieved individual is eligible to file a formal complaint of discrimination. A Notice of Right to File a Formal Complaint that explains their right to file a formal complaint will be issued.
